1. About these terms
These terms of use (“Terms”) govern your access to and use of www.gatewayfinance.com.au and related pages, forms and calculators (the “Site”), operated by Gateway Finance (“Gateway Finance”, “we”, “us”, “our”). By using the Site, submitting an enquiry or lead form (on the Site or through our advertising on platforms such as Facebook, Instagram or Google), you agree to these Terms and to our Privacy Policy at www.gatewayfinance.com.au/privacy-policy. If you do not agree, please do not use the Site.
2. Who we are and what we do
Gateway Finance provides credit assistance services as a finance and mortgage broker. We help clients find, compare, apply for and obtain home loans, refinancing, investment loans, construction loans, personal loans, vehicle loans, and business, asset and equipment finance from a panel of third-party lenders.
We are not a lender or credit provider. We do not lend money, and any loan or credit product you obtain is provided by the relevant lender under that lender’s terms. Approval of any application, and the terms of any credit, are decisions made solely by the lender based on its own credit criteria.
3. Information on this Site is general only
Content on the Site, including articles, guides, FAQs, calculators, rate commentary and social media content, is general information only. It has been prepared without taking into account your objectives, financial situation or needs. It is not credit advice, financial product advice, tax advice or legal advice, and it should not be relied on as such. Before acting on any information, consider whether it is appropriate for your circumstances, and speak with one of our brokers (or an appropriately qualified adviser) so your individual situation can be assessed.
Nothing on the Site is an offer of credit, a quote, or a representation that any particular loan, rate, amount or approval is or will be available to you. Lending criteria, fees, charges and eligibility requirements apply to all credit products and are set by the relevant lender.
4. Calculators and tools
Any calculators or tools on the Site provide estimates only, based on the figures you enter and stated assumptions. They are not a quote, loan offer, or assessment of your eligibility or borrowing capacity, and actual repayments, borrowing capacity and costs will depend on the lender, the product, your circumstances and matters such as fees, charges and interest rate changes. Results should not be your only basis for making financial decisions.
5. Enquiries, lead forms and appointments
- Submitting an enquiry, lead form or callback request does not create a broker-client engagement, and does not obligate us to provide services or you to proceed.
- You agree that the information you submit is accurate and relates to you (or to a person or business you are authorised to represent), and you consent to us contacting you by phone, SMS or email about your enquiry, in accordance with our Privacy Policy.
- Our credit assistance services are provided under a separate credit guide, quote (where applicable) and any engagement documents we give you, which prevail over these Terms in relation to those services.
- Our services are intended for Australian residents aged 18 or over.
6. Fees and commissions
In most cases we are paid commission by the lender if your loan settles, and our credit assistance is provided at no direct cost to you; where a fee is payable by you, it will be disclosed to you before you incur it, in the documents we provide. Details of commissions and any referral arrangements are set out in our credit guide and disclosure documents, which we provide when we assist you.
7. Acceptable use
You must not: use the Site for unlawful purposes; submit false, misleading or fraudulent information or impersonate any person; interfere with the Site’s operation or security, or attempt to gain unauthorised access to any systems or data; scrape, harvest or copy Site content or data by automated means; or use the Site to transmit malicious code or unsolicited communications.
8. Intellectual property
The Site and its content, including text, graphics, logos, images, videos, guides and design, are owned by or licensed to Gateway Finance and protected by law. You may view, download and print content for your personal, non-commercial use. You must not otherwise reproduce, modify, distribute or commercially exploit any Site content without our prior written consent. All trade marks displayed (including lender names and logos) are the property of their respective owners, and their appearance does not imply endorsement.
9. Third-party links and platforms
The Site and our advertising may contain links to third-party websites, platforms and tools (including lender websites, review platforms, and social media). These are provided for convenience; we do not control and are not responsible for their content, availability or privacy practices. Your use of third-party sites is at your own risk and subject to their terms. If you interact with us through platforms such as Facebook, Instagram or Google, those platforms’ own terms and privacy policies also apply.
10. Testimonials and reviews
Testimonials and reviews on the Site or our social channels reflect the genuine experience of the individuals concerned. Individual results depend on personal circumstances, and past outcomes are not a prediction or guarantee of the outcome of any other application.
11. Disclaimers and limitation of liability
We take care to keep Site content accurate and current, but we do not warrant that the Site or its content will be complete, accurate, up to date, uninterrupted, secure or error-free. Interest rates, products, policies and regulations change frequently, and content may be out of date at any time.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Competition and Consumer Act 2010 (Cth) or other law that cannot lawfully be excluded. Subject to that: (a) the Site and its content are provided “as is”; (b) to the maximum extent permitted by law, we exclude all liability for any loss or damage (including indirect or consequential loss) arising from your use of, or reliance on, the Site or its content; and (c) where our liability cannot be excluded but can be limited, it is limited, at our option, to resupplying the relevant services or paying the cost of having them resupplied.
12. Privacy
Our collection and handling of personal information, including information submitted through the Site and through advertising lead forms, is governed by our Privacy Policy at www.gatewayfinance.com.au/privacy-policy, which forms part of these Terms.
13. Changes, suspension and termination
We may update these Terms, and change, suspend or discontinue any part of the Site, at any time without notice. The current version of these Terms will be published on the Site with the date of last update, and your continued use of the Site after changes are published constitutes acceptance of the updated Terms. We may restrict access to the Site by anyone who breaches these Terms.
14. General
These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of that state. If any provision of these Terms is invalid or unenforceable, it is severed and the remaining provisions continue in effect. A failure by us to enforce any right is not a waiver of that right.
